14 year old sexual assault survivor granted permission to terminate pregnancy

In late November, 2018, the Petitioner, the Petitioner, a 14 year old girl, revealed to her mother that she had been sexually assaulted multiple times by two boys who were known to her. An FIR came to be filed at the Mankhurd Police Station on 1st December, 2018. As per protocol, the girl was taken to Rajawadi Hospital for a medico-legal examination. It was discovered that the Petitioner was 21 weeks pregnant. The girl was discharged from Rajawadi hospital as the hospital authorities stated that they would be unable to terminate the pregnancy as it had advanced beyond 20 weeks. The girl was then taken to JJ hospital where she was admitted for about a week. A number of tests were conducted. Once again the hospital authorities expressed their inability to terminate the pregnancy as it had advanced beyond 20 weeks. The girl was then produced before the Child Welfare Committee that subsequently sent a representation to JJ to take appropriate steps to help the girl to terminate the pregnancy. The hospital authorities thereafter contacted Dr. Datar, and the Petition was filed before the Bombay High Court. JJ hospital was directed by the court to give its opinion as to the feasibility of terminating the pregnancy of the Petitioner. The Report of the board was submitted and on 03.01.2018 an order was passed permitting the Petitioner to undergo termination of pregnancy. Read the order attached below.
