The Respondents on the pretext that the deceased was stealing scrap from the factory, tied him up to the gate of the factory and started beating him with a belt and a pipe. Despite the deceased's constant cry, they beat him up and also abused him with caste slurs. The injuries caused were severe and due to multiple injuries on his head and body, the deceased succumbed. Moreover, the entire incident was captured on the mobile phone of one of the accused persons and was widely circulated among friends. Despite various evidences including the video, statements of the eye witnesses to the incident produced by the police officers, the High Court of Gujarat granted bail to the accused person on the ground of 'weak evidence'.
