Delhi High Court Granted Bail To The 'Whistleblower' In Bonded Labour Case

The present Petition has been filed seeking bail in a Case arising out of the FIR No: 257 of 2017 (Dated: 17/08/2017), PS: Ranjit Nagar, U/S: 323/344/354/370/374/343/34 OF IPC, R/W SEC. 16/17 OF THE BONDED LABOUR SYSTEM ABOLITION ACT, 1976 AND SEC. 75/79 OF J.J. ACT District- Central Delhi, currently pending in the Court of Ms. Nivedita Anil Sharma, ASJ, Tis Hazari Court, New Delhi. The Petitioner/Accused has been in judicial custody for 24 months since 13.10.17

The Petitioner/Accused was an informer in the present case and due to his consistent effort and complaint regarding the numerous bonded labourers who were living under the situation of bondage and were engaged as domestic workers. These bonded labourers were placed in various regions of Delhi by R.B Placement Agency, Delhi as domestic workers and were working without any wages. After the complaint made by the petitioner/accused along with the efforts of Mr. Nirmal Gorana, Convener, NCCEBL, these bonded labourers  were rescued from R.B Placement Agency, Delhi by the district administration authorities. However, he was falsely drawn up as an accused even though his name was not mentioned in the above mentioned FIR. The petitioner has filed five bail applications before the District Court all of which were dismissed by the court.

The sixth bail application was filed by Advocates Mr. Gunjan Singh, Mr. Arun Kasi & Ms. Ankita Wilson before the Hon'ble High Court of Delhi on 15th October 2019.

Single Judge bench has mentioned in the order that no useful purpose will be served in keeping the petitioner in judicial custody and granted bail to the petitioner on 04.12.2019.
