Government allows thousands of migrant workers stranded at India-Nepal border to return home after petition in Supreme Court

Ganga Giri Goswami v. Union of India | Supreme Court | Status: Disposed of | |

This petition was filed seeking directions to the Government of India to allow over a thousand Indian migrant workers and over 1,700 Nepalese migrant workers stranded at the India-Nepal border in Uttarakhand after the COVID-19 lockdown was imposed, to return to their respective countries and homes.

The Petitioner had first moved a Writ Petition in the Supreme Court, since the High Court was not functioning due to the lockdown. The Supreme Court in that Writ Petition  directed the High Court to admit the petition and decide it expeditiously. The High Court however declined to grant any relief and deferred the matter to the government's decision-making. Thus the Petitioner challenged the High Court order in this SLP before the Supreme Court.

After the SLP was admitted by the Supreme Court, the Government of India informed the  Court that it had decided to allow the migrant workers stranded at the border to return to their respective homes.
