Habeas Corpus filed against Domestic Violence Victim

Sabith Vs Jamsheera and Others Background Jamsheera, Kunnathu House, Muderi, Kalpetta is married to Sabith, S/o Hanif, Puthenpurayil House, Elangode, Panur, Kannur. Sabith has business in Gulf countries and Kerala. When Jamsheera started to live with Sabith in his house in Kannur, she came to know that he was suffering from severe sauriasis, which he had concealed from her and her parents before the marriage. When she asked about it he became angry and his family members said she has to put up with her husband’s disease. After this she was tortured by her husband and husband’s parents. And one night her husband was not in the house her father-in-law came to her room and misbehaved with her. When she shouted and screamed he took away her children. After that her husband began to beat her and inflict wounds on her body. But she was not taken to the hospital. Later she was forcibly taken to a mental hospital and admitted her saying she was mentally ill. Knowing that her mother had approached the court for issuance of search warrant she was released from the hospital. Later she approached SLIC for legal advice and SLIC filed domestic violence case in Kalpetta and filed police complaint against the mental hospital authorities for illegal detention. When Jamshreera with her two minor children came to live in her mother’s house, Sabith filed a Habeas Corpus petition before the high court. Status On 24th May 2017 SLIC advocate appeared before the High Court of Kerala and produced Jamsheera and her two children and the Habeas Corpus case was closed
