HC directs Union of India to pay 5 lakh each to two petitioners

Imphal, April 11 2019: A judgement order issued by the High Court of Manipur today, directed the Union of India to provide Rs 5 lakh each to one Laishram Prema Devi and one Seram Sunita Devi as compensation. A press release issued by the Director of Socio-Legal Information Centre (SLIC) Manipur conveyed that regarding the present case, two individuals namely Laishram Keshorjit Singh and Seram Priyokumar Meitei were taken away by personnel of 20 Assam Rifles on June 1, 2009 from along Imphal-Moreh road at Tengnoupal check post and thereafter, they were killed in a fake encounter case at Maipi-Angbreshu track on the same day. Thereafter, the personnel involved in the said killing lodged a false report at Kakching PS stating that two individuals were killed in an encounter, it mentioned adding that the wives of the two deceased filed two separate writ petitions in 2014 before the High Court of Manipur seeking compensation and punishment of the culprits involved. It continued that the High Court conducted a fact-finding enquiry through District Judge Thoubal and it was subsequently found that both the deceased were killed by Assam Rifles in a fake encounter and they were not involved with any proscribed organisation. During the hearing today, , a Division Bench High Court of Manipur, comprised of Chief Justice Ramalingam Sudhakar and Justice MV Muralidaran, directed the Union of India to pay a compensation of Rs 5 lakh each to the two petitioner. It may be mentioned that National Campaign for Prevention of Torture, New Delhi, already approached the National Human Rights Commission regarding the killing of the two individuals and consequently, the National Human Rights Commission had recommended paying Rs 5 lakh each to the next of kin of the two deceased. It may also be mentioned that the respondents arrayed in the petition are the Union of India through the Defence Secretary, Home Secretary, Ministry of Home Affairs, Commanding Officer, 20 AR, State of Manipur, DGP Manipur and SP Chandel District, it added.
