Case title: Firoz Vs State of Kerala and others The petitioner is approaching the Hon’ble court aggrieved by the inaction of state Authorities on providing concession rates in every stage carriages for persons with disability with 40% or more disability, irrespective of distance of travel in private, public transport buses and KURTC buses. The petitioner is aggrieved by the limitation of bus concession fares in private buses up to 40kms of travel and non availability of concession fare of 70% in super fast KSRTC buses and KURTC buses for persons with disability is discriminatory in nature and is violation of Art 14 of the constitution of India. The economically poor persons with disability residing in northern districts of Kerala face more ordeals since the majority of stage carriers running in major routes such as thrissur-kozhikode, Kozhikode- Kannur, Kozhikode-palakkad etc are private buses. They are prevented from availing concessions in heavily privatized bus routes. A Letter was received by Mr.Firoz from Transport commissioner stating that the persons with disabilities are allowed 70% concession rate in the stage carriages in state for a limit of 40Kms in distance. The limit of 40kms in distance as stated in the complaint is under the consideration of fair revision committee. Below given are reliefs prayed for: (i). To issue writ of mandamus or direction to consider Ext.P8 and to take decision on providing concession rates in every stage carriages for persons with disability with 40% or more disability, irrespective of distance of travel in private, public transport buses and KURTC buses. (ii). To issue writ of mandamus, declaration, order or direction to create guidelines and standards for disabled people's accessibility to public bus transport after consultation with various groups including groups of persons with disability. (iii). to issue writ, declaration, order or direction for taking measures towards ensuring barrier free environment in public bus transportation in Kerala. Status Disposed with a direction to ensure that representation be considered within three months as per the Rights of Persons with Disabilities Act 2016.
