Case Details and Status This civil writ petition concerned the provision of clean drinking water to flourosis-affected persons of Village Raghunathpura, Tehsil Devli, District Tonk. It was issued under Article 226 of the Constitution of India (Power of High Courts to issue certain writs) and Articles 14 and 21 of the Constitution of India (Equality before law and Protection of life and personal liberty, respectively). On 24 January 2008 the following interim order was passed: “to alleviate the sufferings of the villagers of Raghunathpura, Tehsil Deoli, District Tonk, we direct the Collector District Tonk… to ensure supply of two tankers of potable water daily in the village Raghunathpura, Tehsil Deoli, District Tonk. The Gram Panchayat Islampur shall ensure equitable distribution of water to the villagers of Raghunathpura from the said two tankers. The supply of water by two tankers shall begin from 26.1.2008. The Additional Government Counsel submitted that two tankers of potable water had been supplied daily to Village Raghunathpura, Tehsil Deoli, District Tonk, in compliance with the order dated 24 January 2008. He further submitted that the village would be supplied drinking water adequately once the regional water supply scheme became operational. The learned judge disposed of the writ petition with the following order dated 22 April 2008: “Until the regional water supply scheme becomes operational and adequate drinking water supply is made available to the village Raghunathpura, the interim order dated 24.1.2008 shall remain operative. In other words, the Collector, District Tonk shall ensure of two tankers of potable water daily in village Raghunathpura, Tehsil Deoli, District Tonk until the regional water supply scheme comes into operation”.
