Shahnawaz Choudhary’s custodial death to be investigated by the CBI, Delhi High Court Order

In the ongoing matter of Shahnawaz Choudhary’s custodial death in the month of September in New Delhi, the Delhi High Court has issued latest order on 3rd December’ 2015 and has disposed of the matter. Commenting on the report submitted by the SIT the order said that it has not been conducted “in an impartial and fair manner.” Hence, as prayed for in the petition, the investigation is now transferred to the Central Bureau of Investigation. The police authorities (SIT) are directed to hand over the record of the present case to the Central Bureau of Investigation within a week from the day of order and thereafter the CBI authority shall take up the investigation afresh and conclude the same within a period of six months from the date of taking over the investigation from the police authorities. The DCP, North-East is directed to provide adequate protection and ensure the safety of the eye witness in the case. The statement of the eye witness is to be submitted to the CBI. The order also reads “All India Institute of Medical Sciences, Delhi, Central Forensic Science Laboratory, and Forensic Science Laboratory are directed to transmit their reports/opinions directly to the Central Bureau of Investigation in Delhi. The afore-stated authorities are directed to expedite their reports in view of the gravity and seriousness of the allegations levelled against the officers of the State police.” Responding to the prayer in the petition regarding compensation to the deceased wife and her minor child aged six months, the order read “the Hon’ble Lieutenant Governor of Delhi and the Government of NCT of Delhi shall take a decision in this behalf expeditiously and preferably within one month from today.”
